Citizenship and Immigration Act (2014)

Schedule
This Bill sets out the methods for gaining and losing citizenship in the Republic of Mercury. It also creates the Office for Citizenship and Immigration.

Section 1 - Office for Citizenship and Immigration
a) The Office for Citizenship and Immigration (henceforth "OCI") is created immediately following the enactment of this Bill into Law.
b) The OCI shall be located in the City of Mercury.
c) The OCI shall handle all requests for citizenship, and shall refer any National Criminal Court judgements that stripping a person of their citizenship to the Supreme Court for ratification.

Section 2 - Acquisition of citizenship
a) Any person shall have the right to claim citizenship in Mercury, with the exception of:
-People previously stripped of citizenship by the National Criminal Court as provided for in the Crimes Against the People Act (2013).
-People convicted of serious crimes in other nations.
b) To claim Mercurian citizenship, it is only required to post a Request for Citizenship in the OCI.
c) If citizenship is not granted by the OCI, that person shall have a right of appeal to the Supreme Court, provided this is submitted within seven (7) days of their application being rejected.
d) The Supreme Court will have the power to over-rule the OCI's decision, but if unable to come to a decision within twenty-eight (28) days of the original decision, then the original decision shall stand.
e) A person who has had a citizenship application rejected shall not be allowed to apply again until one hundred and eighty (180) days after the submission of their previous request.

Section 3 - Loss of citizenship
a) Any person that is stripped of their citizenship by the National Criminal will have the automatic right to appeal to the Supreme Court.
b) The Supreme Court will have the power to judge whether the sentence is unduly harsh, and to reduce the sentence as it sees appropriate.
c) The Supreme Court will also have the power to increase any sentence that it sees as unduly lenient.
d) A person who is stripped of their citizenship by the National Criminal Court, and where this decision is upheld by the Supreme Court, shall not have the right to apply again for citizenship until the completion of their sentence.
e) A person who is permanently stripped of their citizenship by the National Criminal Court, and where this decision is upheld by the Supreme Court, shall not have the right to appeal again for a period of five (5) years.

Section 4 - Right to entry
a) All people shall have right to enter the Republic of Mercury, except where they have been disallowed by the Supreme Court.
b) A person may only be disallowed from entering by the Supreme Court.
c) A person who has been disallowed from entering will only have the right to an independent appeal.

Section 5 - Illegal immigration
a) Illegal immigration is defined as entering the Republic of Mercury whilst not having the right to enter.
b) A person who is found guilty of this offence will be permanently stripped of their right to entry.
