Crimes Against the People Act (2013)

Schedule
This Bill seeks to define the offences of treason, espionage, fraud and corruption, as stated in Chapter IV, Article 18 of the Constitution. It also sets the minimum and maximum penalties for such offences.

Section 1 - Treason
a) A person is guilty of the offence of treason if they are convicted of any of the following:
-murder or attempted murder of any elected official or any official -appointed by the President
-attempting to overthrow or severely disrupt the government or any part of the government by deliberate use of force
-espionage
-destruction of government property
-attempting to circumvent a judicial sentence

Section 2 - Espionage
a) The offence of espionage is defined as:
-disclosure of information relating to security or intelligence without lawful authority
-any deliberate act which causes such information to be released to the public

Section 3 - Fraud
a) A person is guilty of fraud if they deliberately use deception to gain for themselves or another person any of the following:
-money
-property
-political office (henceforth "electoral fraud")
b) The exploitation of any legal loophole to circumvent this offence shall be considered a deception of the spirit of the law, and as such is still considered to be fraud.

Section 4 - Corruption
a) A person is guilty of corruption if they:
-Accept or provide of money or other gifts in return for political favours.

Section 5 - Minimum and maximum penalties
a) The minimum and maximum penalties for the offences of treason or espionage are set a the following:
-At a minimum, loss of citizenship and all benefits of such and a permanent ban from any property of the Republic.
-There shall be no maximum penalty for these offences.
b) The minimum and maximum penalties for the offence of fraud are set at the following:
-At a minimum, forfeiture of money, assets or offices gained as a result of the offence.
-At a maximum, forfeiture of money, assets or offices gained as a result of the offence, an unlimited fine and loss of citizenship and all benefits of such.
c) The minimum and maximum penalties for the offence of corruption are set at the following:
-At a minimum, forfeiture of office and two (2) year ban from political office.
-At a maximum, forfeiture of office and loss of citizenship and all benefits of such.
